The deliberate release of GMOs into the environment is controlled at EU level by Directive 2001/18/EC on the deliberate release into the environment of genetically modified organisms and repealing Council Directive 90/220/EEC, which entered fully into force on 17 October 2002. Directive 2001/18/EC introduced:
  • Risk assessments covering indirect and long-term effects of GMO releases on the environment and biodiversity
  • Public consultation for a specified interval before a decision is taken on an application to release a GMO for non-commercial use
  • Monitoring for unanticipated effects on the environment of any GMO receiving consent for commercial use
  • The phase out of GMOs containing antibiotic resistance marker (ARM) genes which may have adverse effects on human health and the environment.
